Ordinances

The Borough of Kenhorst reserves the right to regulate behavior, property maintenance, public safety, parking, solicitation, curfew, water, air, noise pollution, zoning and other ordinances which entail enforcement.

To ensure proper ordinance enforcement, the Borough shall be permitted to file violations and prosecute the same based upon observable conditions at a property or based upon information provided by residents regarding violations. Said violation notice shall be valid based upon observable conditions such as failure to remove snow, the appearance of snow after plowing, the appearance of grass clippings in the street, improper disposal of materials, accrual of improper substances on a property, noise complaints, obtaining evidence of solicitation and similar evidence.

FREQUENTLY REFERENCED BOROUGH ORDINANCES

REAL ESTATE REGISTRY: ORDINANCES #562 and #595

Per Chapter 358 of the Kenhorst Book of Ordinances, Kenhorst Borough has adopted Real Estate Ordinance, No. 562, which requires all residents to complete and return an annual Real Estate Registry form by January 31st of each year. Forms can be found and downloaded below or you may pick up at the Borough Hall. Completed forms can be mailed, faxed, scanned and emailed or directly deposited in the drop box located next to the main entrance to Borough Hall.

Kenhorst Borough Ordinance No. 595 imposes additional penalties for failing to comply with Ordinance No. 562.

PROPERTY MAINTENANCE ORDINANCES

The Borough of Kenhorst has implemented an aggressive property maintenance program. We expect homeowners and businesses to keep properties in good repair and grass no longer than eight (8) inches. A part-time inspector is employed by the Borough to track property maintenance issues.

ANIMAL ORDINANCES

The Borough of Kenhorst has adopted ordinances regarding the care, control and maintenance of animals within Borough property.

It is unlawful for any person to permit any dog or cat under his/her supervision or control, to run at large on public streets, sidewalks, alleys, or property of the Borough, or upon the property of persons other than the owner of the dogs or cats. It is the duty of any owner or sitter within the Borough to always keep their dog either on a leash or other device that keeps the dog under reasonable control, or in an enclosure from which it cannot escape or firmly secured by means of a collar and chain or other device so that it cannot stray beyond the premises on which it is secured.

Owners or keepers of leashed or unleashed animals shall be responsible immediately for the removal and disposal of fecal matter deposited by their animals anywhere within the Borough.

It shall be unlawful to own, harbor or keep in custody any dog, which disturbs the peace by barking, howling, or making other loud noises to the annoyance and discomfort of other residents within the Borough of Kenhorst.

Berks County Dog Licenses

All dogs three (3) months of age or older must be licensed. Licenses are issued by the Berks County Treasurer.

Pennsylvania Dog Laws

State law requires all dogs over three (3) months of age to be licensed. Owners of unlicensed dogs may be subject to fines.

  • All dogs three months of age or older must be licensed. Licenses are issued by the County Treasurer.
  • All dogs must be under control and must not be allowed to run at large. Dogs are personal property, and owners are responsible for damages caused by their dog.
  • It is illegal to mistreat or abuse any animal. Violations should be reported to a local humane organization or the police.
  • It is illegal to abandon or attempt to abandon any dog.
  • No dog under eight weeks of age may be sold, traded, bartered or transferred.
  • You may not place any poison or harmful substance in any place where dogs may easily eat it, whether it is your own property or elsewhere.
  • You must have a current kennel license if you operate a facility that keeps, harbors, boards, shelters, sells, gives away or transfers a total of 26 or more dogs in any one calendar year.
  • Dogs and cats 3 months of age or older are required to have a current rabies vaccination. It is illegal to interfere with an officer or employee of the Pennsylvania Department of Agriculture engaged in enforcement of dog laws.
